1. Acceptance Of These Terms
By accessing or using InkMeld, you agree to these Terms of Service and the related Privacy
Policy and, where relevant, the Cookie Policy. If you do not agree, you must not use
the service.
If you are using InkMeld on behalf of a company, studio, or other organization, you represent that you are
authorized to bind that organization to these terms.
2. Who We Are
InkMeld is a product operated by OakDev & AI AB ("OakDev", "InkMeld", "we", "our", or "us"). References to
the "service" include our website, mobile app, related legal pages, support flows, AI processing endpoints, and
any paid or unpaid features we make available.
3. Eligibility And Age
You may only use InkMeld if you can validly enter into a binding agreement under the law that applies to you. If
you are below the legal age required in your jurisdiction, you may use the service only if a parent or legal
guardian has authorized that use where required by law.
InkMeld is not intended for young children.
4. What The Service Is And Is Not
InkMeld is an AI-assisted tattoo preview tool. It may allow you to import body photos, import tattoo designs,
create cutouts, place artwork on body images, tune realism, save or export previews, buy credits, upgrade plans,
and optionally sync content between devices.
InkMeld is not a medical service, a dermatology service, a biometric identification service, a
legal review service, or a substitute for professional advice from a licensed tattoo artist, doctor, or other
qualified professional. Previews are simulations only and are not guarantees of the final tattoo result.
5. Accounts, Anonymous Sessions, And Linked Sign-In
The app may create an anonymous backend session so credits, purchases, and security controls can function even
before you link a named account. You may later link that session to supported identity providers such as Google or
Apple where available.
You are responsible for maintaining control over your devices, linked accounts, and any contact methods associated
with your session. If you lose access to an anonymous session before linking it, recovery may be limited.
6. License To Use InkMeld
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable
license to use InkMeld for its intended purposes. This is a license only, not a sale or transfer of ownership.
You may not:
- reverse engineer, decompile, disassemble, or attempt to derive source code except where law expressly permits it;
- disable, bypass, or interfere with security or abuse-prevention features;
- use bots, scripts, or automation to overload, scrape, or exploit the service;
- resell, rent, lease, sublicense, or commercially exploit the service except under a separate written agreement;
- remove proprietary notices, branding, or copyright information; or
- use InkMeld in a way that violates law, platform rules, intellectual property rights, privacy rights, or these terms.
7. Your Content And Your Responsibilities
You retain whatever rights you already have in the images, files, body photos, tattoo designs, prompts, exports,
and other content you submit to InkMeld ("User Content"). However, by using the service you grant us a limited
license to host, copy, transmit, transform, analyze, store, display, and otherwise process that User Content only
as necessary to operate, secure, support, and improve the service and to provide the specific features you request.
You are solely responsible for User Content you upload or process. You represent and warrant that:
- you have the legal right to upload and process the content;
- you have any permissions or consents needed from people depicted in the content;
- your use of the content does not infringe copyright, trademark, privacy, publicity, or other rights; and
- your use of the content does not violate law or platform policies.
InkMeld may allow you to import inspiration from the internet or other sources, but you remain responsible for
rights clearance before turning a reference into a real tattoo, a client deliverable, or commercial material.
8. Prohibited Uses
You may not use InkMeld to upload, generate, store, share, or process content that:
- is illegal, fraudulent, deceptive, defamatory, harassing, threatening, or abusive;
- contains unlawful sexual content, child exploitation material, or non-consensual intimate imagery;
- infringes another person's intellectual property or privacy rights;
- is used to impersonate a person or misrepresent affiliation, endorsement, or identity;
- is used to bypass payment, quota, security, or entitlement controls;
- is submitted for stress-testing or scraping in a way that harms the service; or
- otherwise exposes us, our processors, app stores, or other users to legal, security, or reputational risk.
9. AI Features, Output Quality, And Human Judgment
InkMeld may use AI-assisted or automated processing for cutouts, background removal, image refinement, or related
features. Outputs may vary based on source image quality, lighting, body angle, skin tone, cropping, compression,
artistic style, and technical limitations.
You acknowledge that:
- AI output may be incomplete, inaccurate, distorted, or aesthetically unsatisfactory;
- previews are not final render guarantees and can differ from actual tattoo outcomes;
- body contour, movement, healing, ink spread, and artist technique cannot be fully simulated; and
- you remain responsible for reviewing the output before relying on it.
10. Cloud Sync, Local Storage, And Exports
Some InkMeld features store files locally on your device. Other features may upload content to cloud storage or
sync metadata between devices when you choose to use those features.
If you export, save, or share a preview outside InkMeld, you are responsible for how that copy is further used,
stored, disclosed, or deleted. Once a copy leaves InkMeld and is sent to your gallery, mail app, messaging app,
cloud drive, tattoo artist, or client, third-party terms and privacy practices may apply.
11. Credits, Premium Access, And Purchase Verification
InkMeld may use a system of free monthly quota, purchased credits, premium entitlements, or other paid access
models. Available features, prices, bundles, and plan structures may differ by platform, region, campaign, build,
or release stage.
We may use server-side purchase verification before granting credits or premium access. If verification fails, is
incomplete, is duplicated, or indicates suspected abuse, we may delay, deny, reverse, or suspend the related
entitlement to the extent permitted by law and app-store rules.
12. Billing, Refunds, And Withdrawal Rights
Payments made through app stores are processed by the relevant store operator, such as Apple or Google. Refund
requests are generally handled under the app store's own rules and the mandatory consumer law that applies to your
purchase.
For users in the EU, EEA, UK, and similar regimes, distance-purchase and digital-content rules may give you certain
withdrawal rights, but digital content and digital services can also be exempt once delivery has begun with the
required express consent and acknowledgement. Mandatory consumer rights always override conflicting contract terms.
Nothing in these terms limits any non-waivable statutory rights you have regarding faulty digital content, faulty
digital services, delayed delivery, price reduction, termination, or reimbursement under applicable law.
13. Price Changes, Feature Changes, And Service Evolution
We may change prices, bundles, feature availability, usage caps, entitlement rules, supported platforms, or plan
names at any time to the extent permitted by law. We may also add, remove, suspend, replace, or modify features,
including AI models, cloud sync behavior, ad experiences, and premium benefits.
If you have a continuous paid digital service and mandatory consumer law gives you rights when the service changes,
those rights remain unaffected.
14. Third-Party Services And Platforms
InkMeld may rely on third-party providers, including app stores, cloud infrastructure, AI providers,
authentication providers, ad networks, analytics tools, crash-reporting tools, and device operating systems. We are
not responsible for the independent products, policies, uptime, security, content, or legal obligations of those
third parties.
Your use of third-party services may also be governed by separate terms, policies, and platform rules.
15. Suspension And Termination
We may suspend, restrict, or terminate access to all or part of the service if:
- you violate these terms;
- we reasonably suspect fraud, abuse, chargeback abuse, automated misuse, or unlawful conduct;
- continued access creates legal, security, or operational risk;
- a required third-party platform or provider disables an essential dependency; or
- we decide to discontinue some or all of the service.
You may stop using InkMeld at any time. If you want your account deleted, use the process described on
Delete Account.
16. Disclaimers
To the maximum extent permitted by law, InkMeld is provided "as is" and "as available." We do not guarantee that
the service will be uninterrupted, error-free, secure, always available, always accurate, or suitable for your
specific artistic, commercial, or legal needs.
We specifically disclaim warranties, representations, or conditions regarding:
- tattoo realism, design suitability, or final tattoo outcome;
- availability or performance of third-party providers;
- continued availability of any specific feature, AI model, plan, or credit structure;
- compatibility with all devices, stores, regions, or operating systems; and
- non-infringement of third-party rights arising from your chosen inputs or outputs.
Where the law does not allow a disclaimer, the disclaimer applies only to the maximum extent allowed.
17. Limitation Of Liability
To the maximum extent permitted by law, OakDev & AI AB and its officers, employees, contractors, affiliates,
processors, and licensors are not liable for indirect, incidental, special, punitive, exemplary, or consequential
damages, or for loss of profits, revenue, goodwill, data, business opportunity, or reputation arising out of or in
connection with your use of, inability to use, or reliance on InkMeld.
To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to the
service will not exceed the greater of:
- the amount you paid us for the relevant service in the 12 months before the event giving rise to the claim; or
- SEK 1,000.
This limitation does not exclude liability that cannot lawfully be excluded, including liability arising from gross
negligence, intentional misconduct, death, personal injury, or mandatory consumer-protection law where such
exclusions are prohibited.
18. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless OakDev & AI AB and its
related parties from claims, liabilities, damages, losses, and expenses arising from or related to your User
Content, your misuse of the service, your breach of these terms, or your violation of law or third-party rights.
19. Governing Law And Mandatory Rights
These terms are governed by Swedish law, except to the extent that mandatory consumer-protection laws in your
country of residence give you stronger rights or require a different result. Nothing in these terms is intended to
deprive consumers of mandatory rights under applicable law.
If you are a consumer in the EU or EEA, you may also have the right to use local consumer complaint or dispute
channels available under applicable law.
20. Permissions You Grant Us To Operate The Service
You retain whatever rights you have in the content you upload, create, save, or export through InkMeld, subject to
the rights of other people and the law. However, by using the service, you grant us a limited, non-exclusive,
revocable, worldwide right to host, store, reproduce, process, transmit, display, adapt, and technically modify
your content only to the extent reasonably necessary to operate, secure, maintain, improve, and provide the service
features you request.
This can include actions such as generating previews, resizing images, creating thumbnails, synchronizing content
across devices, caching files, performing background removal, verifying purchases associated with your account,
handling support requests, investigating abuse, and deleting or de-linking content when you ask us to do so or when
the law requires it.
This license does not by itself transfer ownership of your content to us, and it does not mean we may use your
content for unrelated commercial exploitation outside the service without a separate legal basis, permission, or
agreement.
21. Feedback And Suggestions
If you send us feedback, ideas, feature requests, bug reports, product suggestions, workflow concepts, or other
comments about InkMeld, you agree that we may use that feedback without restriction or compensation to the extent
permitted by law. This helps us improve the service without creating uncertainty about whether ordinary user
suggestions can be acted upon.
Please do not submit confidential ideas or proprietary proposals unless you are comfortable with that outcome or we
have expressly agreed otherwise in writing.
22. Intellectual Property Complaints And Repeat Infringement
We expect users to respect copyright, trademark, design rights, image rights, privacy rights, and other rights of
third parties. If you believe content associated with the service infringes your rights, you may contact us with
enough detail for us to understand the claim, identify the material, and assess the alleged infringement.
We may remove, disable, restrict, or preserve content while investigating a complaint. We may also request more
information from the complaining party or the affected user, and we may reject notices that are incomplete,
misleading, abusive, or unsupported.
Where appropriate and legally justified, we may suspend or terminate accounts associated with repeated infringement,
repeated fraudulent takedown claims, or repeated misuse of the complaint process.
23. Beta, Trial, And Experimental Features
From time to time, InkMeld may offer beta, preview, early-access, test, or experimental features. Those features
may change quickly, include usage caps, be less stable, be withdrawn without notice, or operate with limited
support. They may also rely on third-party models, APIs, or infrastructure that have higher latency, lower
availability, or different legal and technical constraints than mature features.
Unless mandatory law says otherwise, beta and experimental features are provided on an especially "as available"
basis. You should not rely on them for mission-critical, medical, legal, or irreversible commercial decisions.
24. Professional, Studio, And Client-Facing Use
If you use InkMeld in a studio, agency, freelance, consulting, or other business setting, you remain responsible
for your own professional obligations to clients, models, collaborators, and end customers. This includes obtaining
any consents, releases, permissions, rights clearances, and notices needed for the material you upload or share.
InkMeld is a creative planning and visualization tool. It is not a substitute for professional tattoo safety
standards, informed consent processes, hygiene requirements, health assessments, licensing obligations, or local
rules governing tattoo practice. You are solely responsible for the real-world tattooing decisions made by you or
your business.
If you show clients AI-generated, composited, or preview imagery, you should make sure the client understands that
the output is a digital visualization, not a guaranteed representation of the final tattoo result on real skin under
real conditions.
25. Force Majeure, Outages, And External Dependencies
We are not responsible for delay, interruption, or failure caused by events outside our reasonable control,
including internet outages, mobile-platform outages, cloud provider failures, denial-of-service attacks, labor
disputes, government action, war, terrorism, civil unrest, natural disasters, epidemics, power failures, or the
suspension of essential third-party services.
InkMeld also depends on operating systems, app stores, payment platforms, identity providers, AI infrastructure,
and cloud services that we do not fully control. If any of those dependencies changes functionality, pricing,
policy, API access, or regional availability, we may need to modify, suspend, or discontinue related parts of the
service.
26. Export Controls And Sanctions
You may not use the service in violation of export-control, sanctions, embargo, or trade-compliance laws that apply
to you, to us, or to the providers supporting InkMeld. By using the service, you represent that you are not
located in, ordinarily resident in, or using the service for the benefit of a person or entity subject to
prohibitions that would make the provision of the service unlawful.
We may restrict or terminate access where necessary to comply with such laws or provider requirements.
27. Assignment, Severability, And No Waiver
We may assign or transfer these terms, in whole or in part, in connection with a merger, acquisition,
reorganization, sale of assets, or operation of law. You may not assign your rights or obligations under these
terms without our prior written consent, except where mandatory law gives you a non-waivable right to do so.
If any part of these terms is found unenforceable, invalid, or unlawful, the remaining provisions will continue in
effect to the fullest extent permitted by law. Our failure to enforce a provision immediately does not mean that we
waive it later.
28. Electronic Communications And Notice
By using InkMeld, you agree that we may provide certain service-related notices electronically, including through
the app, the website, the email address associated with your account where available, or other reasonable digital
means. Electronic notices can include updates about features, security issues, purchases, legal documents, account
changes, and support matters.
You are responsible for keeping your contact details reasonably current and for checking the channels through which
we normally communicate. If a notice is required by law, we will try to provide it in the manner the law requires,
but we cannot guarantee delivery if your contact information is outdated, inaccessible, or incorrectly provided.
29. Account Security And Device Responsibility
You are responsible for maintaining the security of your devices, linked sign-in methods, email accounts, app-store
credentials, and any other credentials or tools used to access InkMeld. If you share devices, fail to use device
locks, or allow others to access your platform credentials, they may gain access to exported images, account data,
purchase state, or saved content.
You should notify us promptly if you suspect unauthorized access, account takeover, fraudulent purchase activity, or
other security problems involving your use of the service. We may take temporary protective measures, but we are not
responsible for losses caused by your own failure to secure your device or credentials where the law allows us to
exclude that responsibility.
30. No Medical, Legal, Financial, Or Professional Advice
InkMeld is a creative and visualization service. It does not provide medical advice, dermatological advice,
infection-control guidance, legal advice, tax advice, financial advice, mental-health advice, or professional
licensing advice. Any information presented through the service is for general informational and creative purposes
only unless we explicitly state otherwise.
Decisions about tattoo placement, skin suitability, aftercare, health conditions, allergies, client consent,
business compliance, and real-world tattoo execution should be made with appropriate professional judgment and, where
needed, qualified advice independent of the service.
31. Survival
Provisions of these terms that by their nature should survive suspension, termination, deletion, or discontinuation
of the service will survive, including provisions relating to payment, refunds already assessed, intellectual
property, user responsibilities, disclaimers, limitations of liability, indemnity, complaint handling, legal
compliance, and dispute-related record retention.
32. Entire Agreement And Interpretation
These terms, together with any other legal terms and policies expressly incorporated by reference, form the general
agreement between you and OakDev & AI AB regarding your use of InkMeld, unless a separate written agreement
applies. If a specific feature is accompanied by additional terms or disclosures, those more specific terms may
govern that feature to the extent of any direct conflict.
Section headings are included for convenience only and do not affect interpretation. Words such as "including,"
"such as," or "for example" are meant to be illustrative, not exhaustive.
33. Changes To These Terms And Contact
We may update these terms from time to time. If we do, we will update the "Last updated" date above and may provide
additional notice where required.
Questions about these terms can be sent to [email protected].
